Minutes of the Threlkeld Parish Council Meeting held at Threlkeld Village Hall, on Tuesday 21 November 2017 at 7.30pm

Present:  Cllr Carolyn Cripps chaired the meeting with Cllr Donald Angus, Cllr Roger Bragg Mick Le’Huray, Cllr Dot Benson, Cllr John Pickering, Cllr Les Dalzell, Cllr David ArkleyCllr Madeleine Singleton and Cllr Richard Sealby (EDC) attended.

2017 / 156 – Apologies

• None

2017 / 157 - Minutes

• The minutes of the Council meeting held on 24 October 2017 was agreed for signing and initialling as a true record (Circulated prior to meeting).

2017 / 158 - Declarations of Interest

• None

2017 / 159 - Exclusion of Press & Public (Public Bodies Admission to Meetings Act 1960)

• Not applicable to any agenda items.  

2017 / 160 - Democratic Half Hour / Public Question Time

• Jo Alberti & Neil Beresford attended the meeting to discuss the public toilets, in relation to the devolution and transfer of assets from EDC to TPC.  
• Neil Beresford advised at the recent Village Hall meeting it had been noted that the village hall had had a successful year.  The railway footpath being out of action is having an impact on the Coffee Shop.  
• The AGM for the Village Hall is on 11 January, all are welcome, Dickon Chaplin-Brice will be doing a speech regarding the future plans for at Threlkeld Quarry.  

2017 / 161 - Eden District Council & Cumbria County Council Representation  

• Cllr Richard Sealby informed the parish council that at the upcoming Housing and Scrutiny Meeting housing needs will be discussed, along with health and wellbeing.  
• Cllr Tom Wentworth-Waites did not attend the meeting.  

2017 / 162 – EDC Devolution and Transfer of Assets

• It was agreed to accept the transfer of the footway lighting, subject to the following conditions:
• On the date of ‘take over’ all footway Lights would have been converted, by EDC, at their expense, to LED bulbs, positioned on a hinged pole and that the 6 year Footway Lighting Electrical Inspection would be up to date and current. 
• The date of ‘take over’ being the 1st April 2018 or the date from which the upgrading of all the Footway Lights in the Parish had been completed, if after the 1st April 2018 and no later than the 31st March 2019. 
• A grant covering the external costs the District Council would otherwise have paid for the delivery of this Footway Lighting service, would be paid to the Parish Council at the current rate (£120.96 per light), from the date of ‘take over’, and annually after that, the grants being awarded would be: 
• 2018/2019 - £1210 (100%) 
• 2019/2020 - £908 (75%) 
• 2020/2021 - £605 (50%) 
• 2021/2022 - £303 (25%) 
• A legal agreement would be drawn up between Threlkeld Parish Council and Eden 
• District Council stating the conditions governing this Devolution of this responsibility. This being signed before the date of ‘take over’. The Parish Council seeking independent legal guidance if necessary. 
• The Parish Council would make its own ‘All Risks’ insurance arrangements. 
• A Training workshop to be organised and financed by EDC to train Parish Council representatives and the Clerk, in Footway Lighting management and Health and Safety requirements. This to have been completed before 1st April 2018.
• It was agreed to accept the transfer of the play area, subject to the following conditions:
• Prior to transfer TPC to meet with EDC to look at the play area, and agree any works which may be required.  On the date of ‘take over’ the play area will have been inspected, and any outstanding works completed
• A grant covering the external costs the District Council would otherwise have paid for the delivery of this play area, would be paid to the Parish Council at the current rate from the date of ‘take over’, and annually after that, the grants being awarded would be: 
• 2018/2019 - £1458 (100%) 
• 2019/2020 - £1094 (75%) 
• 2020/2021 - £729 (50%) 
• 2021/2022 - £365 (25%) 
• A legal agreement would be drawn up between Threlkeld Parish Council and Eden District Council stating the conditions governing this Devolution of this responsibility. This being signed before the date of ‘take over’. The Parish Council seeking independent legal guidance if necessary. 
• The Parish Council would make its own ‘All Risks’ insurance arrangements. 
• A Training workshop to be organised and financed by EDC to train Parish Council representatives and the Clerk, in Play area inspection, management and Health and Safety requirements. This to have been completed before 1st April 2018.
• It was agreed that currently it is not acceptable to decide regarding the toilets.  TPC will support the village hall in acquiring them if possible.  The Clerk to discuss any other options with EDC.  
• To be discussed further at the January meeting.

2017 / 163 - Footway Lighting

• TPC are disappointed to learn that the new light opposite The Sally will be removed, due to no wayleave agreement being made with the parties involved.  The Clerk to write to the owners of the property concerned regarding the wayleave for the light

2017 / 164 - EDC – Community Governance Review

• The correspondence from EDC regarding a Community Governance Review was discussed, and it was agreed that TPC felt no changes were needed at the moment.  

2017 / 165 - Village Notice Board

• Cllr Donald Angus advised that photos have been looked at.
• A location still needs to be agreed
• To be discussed at the January meeting

2017 / 166 - Finance

• 166.1 - The budget for 2018/2019 was discussed and agreed.  It was agreed to set the precept at £10,000.00
• 166.2 - The Bank Reconciliation for November 2017 was approved for signing by the Chairman
